These Terms of Service ("Terms") govern your use of the apps, website, and other services ("Services") provided by Rapid Silence, LLC ("Rapid Silence", "we", "our", or "us"). By using our Services you agree to these Terms.
Our Apps
Our apps are distributed through the Apple App Store and through Setapp. Purchases, licensing terms, and refunds for App Store apps are additionally subject to Apple's App Store Terms of Service. Downloads through Setapp are guided by the terms and conditions of that service.
A one-time purchase grants you a personal, non-transferable license to use the app on devices associated with your Apple ID, consistent with App Store terms. You may not distribute, reverse-engineer, decompile, or create derivative works from our apps except as permitted by applicable law.
Acceptable Use
You agree to use our Services only for lawful purposes and in a manner consistent with these Terms. You will not:
- Use our Services to store, back up, or transmit content that infringes the intellectual property rights of others.
- Attempt to circumvent any security or authentication mechanism in our apps.
- Use our Services in any way that could damage, disable, or impair them.
- Use credentials or access tokens that you are not authorised to use.
Third-Party Services
Our apps integrate with third-party services (GitHub, GitLab, Bitbucket, Apple) at your direction. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.
Disclaimer of Warranties
Our Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our Services will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any loss of data, or usage of our apps that fail for any reason.
You are solely responsible for maintaining adequate backups of your data.
Limitation of Liability
To the fullest extent permitted by applicable law, Rapid Silence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Services, even if we have been advised of the possibility of such damages.
In no event shall our total liability to you for all claims relating to the apps and services exceed the amount you paid us.
Governing Law
These Terms are governed by the laws of the State of South Carolina, USA.
Changes to These Terms
We may update these Terms from time to time. We'll update the "last updated" date and, for material changes, notify you through the website or by email if we have your address. Continued use of our Services after changes constitutes acceptance of the revised Terms.
